  • Reception: The Imperial Security Force Act 863 (IA) received broad praise from the Felist and Tarkinist factions of the Imperial polity. It represents a great bound forward in the centralisation of power to the central government and hands of the Imperator. It is giving the Imperator as the commander-in-chief and head-of-state command over a newly formed branch of the military which also serves as the primary and premier police organisation in the Imperial community. It results from a broader effort to diffuse and dilute the political independence of the various warlords and their governate defence forces by creating a Gendarmerie with superior equipment and training to local forces and to unify the worlds of the New Imperial Order under the centralised control of the central government. Palleonists and Warlords, for the most part, viewed the legislation with suspicion at best and thinly veiled hatred at worst, as it permitted the creation of a new military branch filled with officers who are sworn to serve the Sovereign Imperator with civil policing powers in all New Imperial Jurisdictions. The legislation and associated organisation it created are seen by some as the beginning of the end of warlordism and the rise of an undivided Imperial sun forged from iron.

  • Part 1: Introduction
    • Section 3: Definition(s):
      • Administrator means a member of the Imperial Security Force other than a Security Officer.
      • Commissioned security officer means a security officer of or above the rank of Second Lieutenant.
      • Non-commissioned security officer means a security officer under the rank of Sergeant.
      • Security officer means a member who is a sworn member of the Imperial Security Force.

    • Section 10: Director control and management:
      1. The Director of the Imperial Security Force is subject to the directions of the minister of defence in relation to military matters, and to the directions of the minister of the interior in relation to civil policing matters.
      2. The Director may at their discretion dictate the various duties that the members of the Imperial Security Force are required to perform.
      3. The Director may issue, amend or revoke directions or instructions to members of the Imperial Security Force concerning the operational and administrative control of the Imperial Security Force.
      4. The Director may on behalf of the state and the Imperator enter into a contract or arrangement with any person or organisation for the provision of goods or services in connection with the Function and Purposes of the Imperial Security Force.
    • Section 11: Appointment of Security Officer(s):
      1. The Director may -
        1. Create or liquidate any position in the Imperial Security Force.
        2. Classify the rank or grade of each position in the Imperial Security Force according to the military pay scale for sworn members or civil service pay scale for unsworn members.
        3. Establish, abolish or change the name of any branch or any other part of the Imperial Security Force.
      2. The Director is required -
        1. To designate the positions in the Imperial Security Force to be held by sworn members.
      3. The Director is a Security Officer.

      1. The ranks (in descending order) are as follows.

    • Section 14: Oaths to be sworn or affirmed by security officers.
      1. Before any person may exercise the function, purpose and powers of a security officer, the person must take the oath or affirmation of a security officer.
      2. An oath or affirmation is to be administered and made before the Director or in lieu of the Director, a Deputy Director or Assistant Director.
    • Section 15: Additional functions and powers.
      1. A security officer shall in addition to any other function, purpose or power conferred on them by any other law, shall also be entitled to the powers conferred on a constable, correctional officer, marshall, military police, military provost, prison officer, sheriff or police officer by the state or any of its' subordinate governates.
    • Section 34: Appointment of the Director
      1. The Director of the Imperial Security Force shall be appointed by the Imperator on the recommendation of the Vizier.
      2. The person the Imperator appoints as Director must be an existing member of the Imperial Security Force.
      3. The person appointed to the office of the Director must be a security officer.
      4. The Minister of Interior is responsible for inviting applications for the appointment of the Director when that office is vacated.
    • Section 35: Appointment of an Acting Director
      1. The Minister of Interior may appoint an Acting Director if the office is vacant or if the Director is suspended, incapacitated or otherwise absent.
      2. A member appointed as Acting Director shall be entitled to the role, functions, purposes and powers of the Director.
      3. The Minister of Interior may at any such time they deem appropriate terminate the appointment of a person to the role of Acting Director.
    • Section 36: Removal of the Director.
      1. The Imperator may remove the Director from office on the recommendation of the Vizier, should the Vizier come to lose confidence in the ability of the Director to discharge the role, functions and powers of their office or if the Vizier should come to suspect the Director of engaging in conduct that would amount of serious criminal offences.
      2. Any such Director that is removed from office shall be entitled to compensation and the appropriate pension entitlements of the office.
      3. Any such Director removed from office for a loss of confidence shall be demoted to Colonel and excluded from applying for the role of Director for a period of one standard year.
      4. Any such Director removed from office due to serious maladministration shall be discharged dishonourably from the Imperial Security Force and be excluded from the Imperial Security Service unless otherwise pardoned by the Imperator.
    • Section 37: Vacation of Office by Director
      1. The office of the Director shall be vacated if the Director -
        1. Dies.
        2. Is removed from office as per section 36 of this act.
        3. Retires.
        4. Resigns their office.
Offence-creating Section(s):
  • Part 9A: Offences relating to the Imperial Security Force
    • Section 173A: Bribery and Corrupt Conduct.
      1. Any member of the Imperial Security Force who receives or solicits a bribe in pecuniary assets or otherwise is guilty of an offence.
      2. Any person who solicits or offers any bribe or any other advantage to a member of the Imperial Security Force to induce that member to neglect their duty or influence that member in the exercise of their functions under this or any other act, or improperly take advantage of that member's position is guilty of an offence.
      3. An offence under this section is an indictable offence and punishable for a minimum mandatory of 3 years imprisonment and a maximum penalty of 10 years imprisonment.
    • Section 173B: Neglect of Duty or Refusal of Lawful Order.
      1. Any security officer who neglects or refuses to obey any lawful order or carry out any lawful duty as a security officer is guilty of an offence.
      2. An offence under this section is punishable by a maximum penalty of a fine totalling 2 penalty units or 200 credits.
    • Section 173C: Protection from reprisals for disclosures of misconduct.
      1. Any member of the Imperial Security Force who takes detrimental action against any member of Imperial Security Force in reprisal for the other member making a protected misconduct allegation is guilty of an offence.
      2. An offence under this section is punishable by a maximum penalty of twelve months imprisonment.
Power Section(s):
  • Part 10: Discipline and Misconduct Management
    • Section 183: Director may take disciplinary action with respect to misconduct or unsatisfactory performance.
      1. The Director, one of their authorised delegates or a commissioned officer of the rank of captain or above may order the following action against a security officer of subordinate rank who that person forms the opinion has engaged in misconduct
        1. A reduction in the security officer's rank or pay grade.
        2. A deferral in salary increment.
    • Section 183A: Revocation of Promotion:
      1. The Director may upon order revoke the promotion of a security officer who in the Director's opinion engaged in misconduct that aided the security officer in obtaining the promotion and returns the security officer to their previously held rank.
    • Section 191: Director power to remove security officers
      1. The Director may by order, in writing, remove a security officer from the Imperial Security Force if the Director loses confidence in an officer's ability to discharge their function, purpose and powers with competence and integrity.
      2. A Director may not without the approval of the Minister of Interior make an order under subsection 1 against a Deputy Director, or Assistant Deputy Director.
    • Section 192: Review of Director's decision to remove a security officer under Section 191.
      1. A Security officer removed by the Director under an order made per Section 191 may apply to the office of the Minister of the Interior for a review of that order on the grounds that the removal is harsh, disproportionate or unjust.
  • Part 11: Critical Incident Management Powers
    • Section 202: Order to suspend civil justice proceedings.
      1. The Director may make a provisional order made in writing to a local government jurisdiction suspending civil justice proceedings and direct the Imperial Security Force to administer military justice in lieu of civil justice proceedings. The Director must specify the affected jurisdiction where the Director believes that the order is necessary to prevent or neutralise actual or imminent threat of invasion, rebellion or significant risk to the public safety. The duration of the order made by the Director in such a circumstance can only be as long as the Director believes is reasonably necessary to prevent or neutralise the invasion, rebellion or significant risk to public safety.
      2. The Director must as soon as reasonably practicable transmit a copy of the provisional civil justice suspension order to a justice of the supreme imperial court, setting out their grounds for applying for the order.
        1. A justice of the Supreme Imperial Court who approves a provisional civil justice suspension order, must not approve an order for a duration longer than 30 days.
        2. A justice of the Supreme Imperial Court must revoke the provisional order if they are not satisfied the suspension of civil justice is necessary for the prevention of invasion, rebellion or significant risk to public safety or an imminent risk thereof.
HISTORICAL INFORMATION
The Imperial Security Force Act 863 (IA) is legislation passed by the Imperial Assembly of the New Imperial Order. It was introduced to the legislature in 863 ABY as a bill to create a branch of the Imperial Military that would serve to absorb the military police function of the various different military services' military police forces and create a civil policing authority that would have broad legal and operations jurisdiction to give the central government the means to enforce their law on every world in the expanding New Imperial Order. The legislation is underpinned by Felism and Tarkinism with a desire for increased control and a broad movement toward centralising political power in the Imperial Government.


The legislation created a Gendarmerie known as the "Imperial Security Force". The creating instrument contains procedural powers and offence-creating sections. Most notably, it was amended in 867 ABY on the recommendation of the serving Director at the time to create several offences relating to bribery, corrupt conduct and the refusal of lawful orders or neglect of duty. Permitting the Imperial Security Force's prosecutors to pursue charges against individuals attempts to bribe or coerce officers to engage in corrupt conduct and unscrupulous or neglectful officers. In terms of the power structure it creates, the Imperial Security Force is under civil control albeit loosely, with its' agency executive being nominated by the Vizier and approved by the head of state in the Imperator. Although, its' everyday activities are monitored and administered by the Ministry of Defence and Ministry of the Interior.
