Description: The Constitution is the document which created the Core Imperial Confederation as a legal entity and government, laying out its' mechanisms from the legislature to courts. The Core Imperial Confederation's constitution is a synthesis of the ideas adopted by the late Galactic Republic with their constitutional amendments to the Galactic Constitution and early Galactic Empire's Imperial Charter both of these governments featured Sheev Palpatine as its' head of state and government. The Confederation's constitution honours Sheev Palpatine as their Monarch in Absentia making it a De Jure Constitutional Monarchy while in practice it is more akin to a De Facto Authoritarian One-Party State.

Reception: The Constitution has met mixed reception across the Galaxy on one hand some observers might note that in comparison to former Imperial Governments it is noticeably more generous in regards to the protection of its' Citizens' rights although this is quickly balanced by the fact that the Constitution itself is discriminatory in regards to who is eligible for Citizenship, there is humanocentrism rooted subtly and sometimes overly in its' amendments. As an example of the Constitution's interesting balance between good and evil, Citizens accused of serious indictable offences are guaranteed a trial by jury however Non-Citizens are given no such guarantee under the Constitution's provisions and the trials that do occur are not explicitly to be open permitting Federation Courts to prevent media access or reporting on some legal proceedings where the Courts issue suppression orders. Pragmatists tend to praise the ostensible balance the Core Imperial Confederation's constitution strives for between Order and Freedom while more hardline principled idealists slam it for not adequately protecting the rights of Semi-Sentients, Humanoid Aliens and Non-Humanoid Aliens, as many protected rights within the constitution are reserved exclusively for "Citizens" and the only individuals who procure this coveted treasure automatically are Humans and certain "Near-Human" Species.

Overview: The Byss Convention was convened by Tanomas Graf who had fled from First Imperial Space after charges for treason were served on the man. Calling together a band of wealthy, influential and loyal individuals who Tanomas knew personally for financial, political and moral support in laying the Core Imperial Confederation's legal groundwork in addition to securing the necessary social capital to lend his offer to the initial member systems power and legitimacy in equal measure.

CONTENT INFORMATION

Constitutional Amendments:
  • First Amendment:
    Parliament shall make no law regarding the establishment of religion, or prohibit the free exercise thereof. Parliament may make no law abridging the Political or Civil Speech of any Citizen or the right to peaceably assemble, and may petition their Imperial Government for redress of Grievances.

[*]Second Amendment:
  • Each Citizen forming the body politic being the best protection against foreign intruders shall be endowed a responsibility for the security of their state, the right of Citizens to keep and bear arms shall not be infringed. But no Citizen exercising their right to bear arms shall be compelled to render military service and Conscription shall be prohibited.

[*]Third Amendment:
  • No military personnel in a time of peace shall be permitted to quarter, occupy or utilize the Private property of any Citizen without that Citizen's explicit consent in a legal process to be prescribed by law.

[*]Fourth Amendment:
  • The right of Citizens to be secure in their persons, houses, papers and effects against unreasonable searches and seizures shall not be violated, no Warrants shall issue, but upon probable cause supported by oath or affirmation, and must particularly describe the place to be searched and the persons or things seized.

[*]Fifth Amendment:
  • No Citizen shall be expected to answer for a Capital or Indictable Offence unless an indictment issued by the court is obtained and produced, except in the cases of the armed forces during active service in a time of war or public danger. No Citizen shall be subject to the same offence to be put twice in jeopardy of life or limb; nor shall any Citizen be compelled in any criminal prosecution to be a witness against themselves nor be deprived of life, freedom or property without the orderly process or law; nor will private property be seized for public use without just and fair compensation.

[*]Sixth Amendment:
  • In all Criminal Prosecutions, accused Citizens shall be entitled to a speedy trial wherein the alleged crime shall have been committed, with the district being previously ascertained and determined by law, the accused shall be informed of the nature and cause of accusation and be confronted with witnesses against them; to have compulsory mechanisms for accessing and obtaining witnesses in their favour and access to counsel assistance for their defence.

[*]Seventh Amendment:
  • In suits at common law, where the value of whatever controversy presented to the court exceed twenty-thousand credits, the right of trial by jury shall be preserved and no fact, tried by a jury of Citizens shall be otherwise re-examined in any court of the Imperial Confederated Systems of the Core Worlds, according to the rules of the common law.

[*]Eighth Amendment:
  • No Citizen accused of a criminal offence shall have excessive bail levied upon them, nor disproportionate fines imposed, not cruel or unusual punishments inflicted.

[*]Ninth Amendment:
  • The enumeration in the Constitution, of certain rights and entitlements, shall not be construed to deny or disparage others retained by the Citizenry.

[*]Tenth Amendment:
  • Powers not delegated to Colonies by the Government of the Imperial Confederated Systems of the Core Worlds are reserved by the Imperial Confederated Systems of the Core Worlds Government respectively or to the Citizens.

[*]Eleventh Amendment:
  • The Judicial Power of the Imperial Confederated Systems of the Core Worlds shall not be construed to extend to any suit in law or equity, commenced or prosecuted against a Citizen of the Imperial Confederated Systems of the Core Worlds by Citizens or Subjects of any foreign state.

[*]Twelfth Amendment:
  • Article 1: Party Electors shall meet within their respective Colonies and vote by Ballot for High Chancellor and Deputy Chancellor, one of whom hall not be an inhabitant of the same Colony with themselves; they shall name in their ballots the person voted for High Chancellor, and in distinct ballots the person voted for as Deputy Chancellor, and they shall make distinct lists of all persons voted for as High Chancellor, and all persons voted for as Deputy Chancellor and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the Imperial Confederated Systems of the Core Worlds, directed to the President of the Senate; The person having the greatest number of votes for High Chancellor, shall be the High Chancellor, if such number be a majority of the whole number of Party Members appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as High Chancellor, the assembly shall choose immediately, by ballot, the High Chancellor.
  • Article 2: But in choosing the High Chancellor, the votes shall be taken by the Colonies, the representation from each Colony having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the Colonies, and a majority of all the Colonies shall be necessary to a choice. And if the Assembly shall not choose a High Chancellor whenever the right of choice shall devolve upon them, then the Deputy Chancellor shall act as Chancellor, as in the case of the death or other constitutional disability of the High Chancellor. The person having the greatest number of votes as Deputy Chancellor, shall be the Deputy Chancellor, if such number be a majority of the whole number of Party Electors appointed, and if no person have a majority, then from the two highest numbers on the list, the Senate shall choose the Deputy Chancellor; a quorum for the purpose shall consist of two-thirds of the whole number of Senators, and a majority of the whole number shall be necessary to a choice. But no person constitutionally ineligible to the office of High Chancellor shall be eligible to that of Deputy Chancellor of the Imperial Confederated Systems of the Core Worlds.

[*]Thirteenth Amendment:
  • Article 1: Neither slavery nor involuntary servitude, except as a punishment for a crime where the party of such involuntary servitude has been duly convicted or has been purchased by the state to serve as a clone soldier, shall exist within the Imperial Confederated Systems of the Core Worlds.
  • Article 2: Parliament shall be empowered to enforce this amendment through appropriate legislation.

[*]Fourteenth Amendment:
  • Article 1: All Humans and Near-Humans born or naturalised in the Imperial Confederated Systems of the Core Worlds, and subject to the Jurisdiction thereof are Citizens of the Imperial Confederated Systems of the Core Worlds and of the Colony wherein they reside.
  • Article 2: No Colony shall make or enforce any law which shall abridge the privileges or immunities of Citizens of the Imperial Confederated Systems of the Core Worlds, nor shall any Colony deprive any Citizen of life, freedom or property without due process of law.
  • Article 3: Representatives shall be apportioned among the Colonies according to their respective numbers, counting the whole number of persons in each Colony, excluding indigenous Aliens not taxed. But when the right to vote at any election for the choice of electors for High Chancellor and Deputy Chancellor of the Imperial Confederates Systems of the Core Worlds, Representatives in the Senate, the Executive and Judicial officers of a Colony, or the members of the Legislature thereof, is denied to any of the inhabitants of such Colony, being twenty-one years of age, and citizens of the Imperial Confederated Systems of the Core Worlds, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such citizens shall bear to the whole number of citizens twenty-one years of age in such Colony.
  • Article 4: No person shall be a Senator or Representative in Parliament, or elector of High Chancellor and Deputy Chancellor, or hold any office, civil or military, under the Imperial Confederates Systems of the Core Worlds, or under any Colony, who, having previously taken an oath, as a member of Parliament, or as an officer of the Imperial Confederated States of the Core Worlds, or as a member of any Colonial legislature, or as an executive or judicial officer of any Colony, to support the Constitution of the Imperial Confederates States of the Core Worlds, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Parliament may, by a vote of two-thirds of each House, remove such disability.
  • Article 5: The validity of the public debt of the Imperial Confederated Systems, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the Imperial Confederated Systems nor any Colony shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the Imperial Confederated Systems, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.
  • Article 6: The Parliament shall have the power to enforce, by appropriate legislation, the provisions of the articles of this amendment.

[*]Fifteenth Amendment:
  • Article 1: The right of Citizens of the Imperial Confederated Systems of the Core Worlds to vote shall not be denied or abridged by the Imperial Confederated Systems of the Core Worlds or any Colony on account of Race or Previous Condition of Servitude.
  • Article 2: The Senate shall have the power to enforce this amendment through appropriate legislation.

[*]Sixteenth Amendment:
  • Article 1: Representatives and direct taxes shall be apportioned among the several Colonies which may be included within this Commonwealth, according to their respective Numbers.
  • Article 2: The Senate shall have Power to lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the Imperial Confederated Systems of the Core Worlds.
  • Article 3: No Capitation, or other direct, Tax shall be laid, unless in proportion to the Census or Enumeration herein before directed to be taken.
  • Article 4: No Tax or Duty shall be laid on Articles exported from any Colony.

[*]Seventeenth Amendment:
  • Article 1: The Senate of the Imperial Confederated Systems of the Core Worlds shall be composed of two Senators from each System, elected by Citizens residing thereof, for six years; and each Senator shall have one vote. The electors in each Colony shall have the qualifications requisite for electors of the most numerous branch of the Colonial Legislatures.
  • Article 2: When vacancies happen in the representation of any Colony in the Senate, the Governor of such Colony shall issue writs of election to fill such vacancies.
  • Article 3: This amendment shall not be so construed as to affect the election or term of any Senator chosen before it becomes valid as part of the Constitution.

[*]Eighteenth Amendment:
  • Article 1: The right of citizens of the Imperial Confederated Systems of the Core Worlds to vote shall not be denied or abridged by the Imperial Confederated Systems of the Core Worlds or by any State on account of sex.
  • Article 2: The Senate shall have the power to enforce this article by appropriate legislation.

[*]Nineteenth Amendment:
  • Article 1: The terms of the High Chancellor and Deputy Chancellor shall only be permitted to end only upon voluntary resignation, incapacitation or death, and the terms of Senators and Assemblymen after six standard years; and the terms of their successors shall then begin.
  • Article 2: The Senate shall assemble at least once in every year, and such meeting shall begin at noon unless they shall by High Chancellor's degree appoint a different time.
  • Article 3: If, at the time fixed for the beginning of the term of the High Chancellor, the High Chancellor-elect shall have died, the Deputy Chancellor-elect shall become High Chancellor. If a Chancellor shall not have been chosen before the time fixed for the beginning of his term, or if the High Chancellor-elect shall have failed to qualify, then the Deputy Chancellor-elect shall act as High Chancellor until a High Chancellor shall have qualified; and the Senate may by law provide for the case wherein neither a High Chancellor-elect nor a Deputy Chancellor-elect shall have qualified, declaring who shall then act as High Chancellor or the manner in which one who is to act shall be selected, and such person shall act accordingly until a High Chancellor or Deputy Chancellor shall have qualified.
  • Article 4: The Senate may by law provide for the case of the death of any of the persons from whom the Assembly may choose a High Chancellor whenever the right of choice shall have devolved upon them, and for the case of the death of any of the persons from whom the Senate may choose a Deputy Chancellor whenever the right of choice shall have devolved upon them.

[*]Twentieth Amendment:
  • Article 1: The District constituting the seat of Government of the Imperial Confederated Systems shall appoint in such manner as the Parliament may direct: A number of electors of High Chancallor and Deputy Chancellor equal to the whole number of Senators and Assemblymen in Parliament to which the District would be entitled if it were a Colony, but in no event more than the least populous Colony; they shall be in addition to those appointed by the Colonies, but they shall be considered, for the purposes of the election of High Chancellor and Deputy Chancellor, to be electors appointed by the party and they shall meet in the District and perform such duties as provided.
  • Article 2: The Parliament shall have the power to enforce this article by appropriate legislation.

[*]Twenty-First Amendment:
  • ​Article 1: No person shall be elected to the office of the High Chancellor more than once. But this Article shall not apply to any person holding the office of High Chancellor when this Article was proposed by the Parliament, and shall not prevent any person who may be holding the office of High Chancellor, or acting as High Chancellor, during the term within which this Article becomes operative from being elected to the position of High Chancellor or from acting as High Chancellor.

[*]Twenty-Second Amendment:
  • Article 1: Imperial Confederated Systems Citizenship shall confer unto the holder a right to membership to the Imperial People's National Party, this right shall not be denied or abridged by the Imperial Confederated Systems or any Colony.
  • Article 2: The right of Citizens of the Imperial Confederated Systems to vote in any primary or other election for High Chancellor or Deputy Chancellor, for electors for High Chancellor or Deputy Chancellor, or for Senator or Representative in Parliament, shall not be denied or abridged by the Imperial Confederated Systems or any Colony.

[*]Twenty-Third Amendment:
  • ​Article 1: In Case of the High Chancellor's Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, the Same shall devolve on the Deputy Chancellor...
    ​Section 1: Whenever there is a vacancy in the office of the Deputy Chancellor, the High Chancellor shall nominate a Deputy Chancellor who shall take office upon confirmation by a majority vote of both Houses of Parliament.
  • Section 2: Whenever the High Chancellor transmits to the President of the Senate and the Speaker of the Assembly his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Deputy Chancellor as Acting High Chancellor.
  • Section 3: Whenever the Deputy Chancellor and a majority of either the principal officers of the executive departments or of such other body as Parliament may by law provide, transmit to the President of the Senate and the Speaker of the Assembly their written declaration that the High Chancellor is unable to discharge the powers and duties of his office, the Deputy Chancellor shall immediately assume the powers and duties of the office as Acting High Chancellor. Thereafter, when the High Chancellor transmits to the President of the Senate and the Speaker of the Assembly his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Deputy Chancellor and a majority of either the principal officers of the executive department or of such other body as Parliament may by law provide, transmit within four days to the President of the Senate and the Speaker of the Assembly their written declaration that the High Chancellor is unable to discharge the powers and duties of his office. Thereupon Parliament shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Parliament, within twenty-one days after receipt of the latter written declaration, or, if Parliament is not in session, within twenty-one days after Parliament is required to assemble, determines by two-thirds vote of both Houses that the High Chancellor is unable to discharge the powers and duties of his office, the Deputy Chancellor shall continue to discharge the same as Acting High Chancellor; otherwise, the High Chancellor shall resume the powers and duties of his office.

[*]Twenty-Forth Amendment:
  • ​Article 1: The right of citizens of the Imperial Confederated Systems, who are eighteen years of age or older, to vote shall not be denied or abridged by the Imperial Confederated Systems or by any Colony on account of age.
  • Article 2: The Parliament shall have the power to enforce this article by appropriate legislation.

[*]Twenty-Fifth Amendment:
  • ​Article 1: No law, varying the compensation for the services of the Senators and Representatives, shall take effect, until an election of Representatives shall have intervened.


HISTORICAL INFORMATION
  • 855 ABY: Sometime in 855 ABY the men and women who would form the initial members of the Imperial Confederation's Parliament began drafting a Constitution for their new government, taking Inspiration from the ideas of the Imperial Charter and Galactic Constitution of the Galactic Republic at around 19 years before the Battle of Yavin just prior to the transformation of that Government into the First Galactic Empire under Sheev Palpatine I. The Core Imperial Confederation Constitution's first draft was reviewed by the Provisional Imperial Cabinet and Tanomas Graf along with the those Representatives from the initial Sectors and Colonies which would form the First Parliament.
  • 856 ABY: The First Imperial Parliament begins its' sitting year and concurrently with the Government coming into lawful existence the digital and paperback copies of the Constitution is published all across the Galaxy with the final executed version of the Draft bearing original hand-written signatures that became the Constitution being stored in the Royal Imperial Archives on Coruscant within the Federal District nearby the Senate Building and Imperial Palace the formal residence of the First Family of the Imperial Confederated Systems.
